General Terms and Condition:
There are basically three steps to achieve a successful
Internet presence for your business or organisation: (a) Web Site Design
(b) Promotion of the Web Site (c) Maintenance. Various options are available
for Web site design, and we can help you decide which is best suited to
you.
Design
Includes all design concepts, development and completion, plus artwork in digital
format. This does not include any pre-press work, printing, production or
implementation costs, although these can be undertaken as separate work.
All materials - text content and photographs - to be supplied by the customer
in digital form via email or by post. All instructions must be confirmed
in writing or by e-mail.
Copyright in all designs remains with Web Imagine indefinitely.
Site owners will agree to a link to http://www.webimagine.co.uk being discreetly
placed upon their site. We will not be involved in any site which is, in
our opinion, not legal, decent, honest or truthful.
The copyright for all text, photographs and logos supplied by the site owner
must lie with the site owner. All such material will be assumed to be the property
of the client and free to use without fear of breach of copyright laws.
Web Imagine makes every effort to design pages which display acceptably in
the most popular current browsers, but cannot accept responsibility for pages
which do not display acceptably in new versions of browsers released after
pages have been designed. This can be undertaken as a separate work.
Web Imagine will initially place the client's website on Web Imagine server
during the website development cycle in order that the client may view and
comment upon the website's progress.
If requested, we will assist a site owner with arranging for web hosting at
additional cost, payable in advance: the choice of web host lies with the site
owner. We can help with this choice but in no event will we be liable for any
loss of business or profit, direct or otherwise, through any delay or failure
of the site.
We will upload and maintain sites, at additional cost; site owners will be
obliged to allow us access to their site, including provision of appropriate
passwords and access codes.
Fees
Each web site project will have a design fee agreed in advance by the client
and Web Imagine verbally or in writing. Fees are payment for our design time
only and do not include any costs associated with Internet services which
may be arranged separately if required. To begin the web site design process
up to 50% of the total balance is due at the start of the project.
Payment
By cheque or cash within 14 days of the date on the invoice. We do not currently
accept credit cards. Two instalments are required, up to 50% retainer fee
on acceptance of our proposal and the balance to be paid prior to delivery
of the finalised web site. Ownership of the product remains with Web Imagine
until payment is made.
Additional changes
The client shall be responsible for payment for any changes requested after
approval of the final design, after final payment or when outside the scope
of the original proposal.
Cancellation
In the event of a project cancellation, a cancellation fee based on the original
total project fee for the proportion of work completed shall be payable by
the client.
Modifications
Any modifications to the agreed proposal should be made in writing or by email.
Invoices may include any fees or expenses that were authorised verbally in
order to expedite a project.
Limitation of liability
Web Imagine shall not be held liable for any incidental or consequential damages
which arise from the failure to perform any aspect of the project in a timely
or acceptable manner, regardless of whether such failure was caused by intentional
or negligent acts or omissions of Web Imagine or a third party. Web Imagine
will execute all projects in good faith and in a timely and professional
manner.

Promotion and Maintenance
Web sites should be constantly maintained if they are to be successful. The
structure of your web site should remain basically unchanged, the contents
should be updated regularly. Search engines recommend that you re-submit
your site to them every 30 days, as while new web sites get submitted, yours
could fall further down the list. Search engine optimisation and submissions
are charged as an optional extra and price depends upon business area and
target keywords. Web Imagine can accept no responsibility or liability if
any search engine, online directory or search site, submitted to as part
of a web site promotion commission, chooses not to list a client's web site.
Web Imagine will make every reasonable effort to promote the website effectively
but cannot guarantee high placings in search engine results. We can update
the content of the pages on your web site with the most recent information
about your products and services.
